[Title] Arrangement for Scientific and Technical Cooperation in Standardization, Metrology, and Quality Certification between the Industrial Advancement Administration of the Republic of Korea and the State Bureau of Technical Supervision of the People's Republic of China
The Industrial Advancement Administration of the Republic of Korea and the State Bureau of Technical Supervision of the People's Republic of China (hereinafter "the Parties"), considering their mutual interest in promoting scientific and technical coopertion in the field of standardization, metrology, and quality certification, according to relevant provisions of the September 30, 1992, Arrangement on Scientific and Technological Coopertion (the Agreement) between the Government of the Republic of Korea and the Government of the People's Republic of China,
Have agreed as follows:
Article l
The Parties shall promote scientific and technical cooperation in standardization, metrology, and quality certification.
Article 2
The Parties shall carry out scientific and technical cooperation in the areas referred to in this Arrangement through the following activities;
(a)exchanging national standards, relevant technical infor- mation, and documents
(b)conducting mutual research, including exchanging experts
(c)arranging lectures, seminars, and meetings
(d)cooperating in the field of international standardization
(e)holding regular R.O.K.-P.R.C. meeting on standardization, metrology, and quality certification
(f)sharing experience in operating quality systems under ISO 9000 sandards
(g)cooperating in other areas agreed on by the Parties.
Article 3
1.Either party may use any scientific and technical information obtained in the course of cooperation under this Arrangement for its respectie research and development purposes unless the supplying party expresses explicit objection to such use.
2.The information referred to in paragraph one herein may be communicated to a third party with the consent of the supplying party.
3.Information obtained by either party from a third party may be communicated to the other party with the consent of that third party. Organizations and companies of the respective countries of the Parties shall not be regarded as the third party.
4.Technical information derived from cooperative activities under this Arrangement may be published subject to agreement of the Parties and appropriate legal protection.
5.Achievements resulting from cooperative research conducted under this Arrangement shall be shared by the Parties based on the principles of reciprocity and mutual benefit.
Article 4
Actions carried out under this Arrangement shall be subject to the laws and regulations in force in the respective countries of the Parties.
Article 5
1.The sending party shall, in principle, bear all expenses arising from dispatching its experts to the country of the other party under this Arrangement.
2.This Arrangement shall work out details related to exchanging experts in advance.
Article 6
1.This Arrangement shall enter into force thirty days after the date of signing and remain in force for three years.
2.This Arrangement shall remain in force thereafter unless "the Agreement" ceases to be effective or either party notified the other in writing of its intention to terminate this Arrangement six months in advance.
3.This Arrangement may be revised by mutual consent. Revision or termination of this Arrangement shall not affect rights and obligation accruing or incurred under this Arrangement before the effective date of such revision or termination.
Done in Beijing on June 9, 1994, in duplicate, of Chinese, English and Korean versions, all texts being equally authentic. In case of divergence in interpretation, the English version shall prevail.
