[Title] MEMORANDUM OF COOPERATION BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE UNITED REPUBLIC OF TANZANIA ON THE JOINT CREDITING MECHANISM
The Government of Japan duly represented by the Ambassador of Japan to the United Republic of Tanzania and
The Government of the United Republic of Tanzania duly represented by the Permanent Secretary of the Vice President's Office (hereinafter referred to individually as a "government" and collectively as "both governments"),
RECOGNIZING that both governments share a mutual interest in promoting cooperation in the Joint Crediting Mechanism between the two countries for mutual benefits;
DESIRING to promote cooperation in the Joint Crediting Mechanism, collaboration and coordination for mutual benefits, particularly for reducing greenhouse gases emissions and promoting good practice and healthy environments between the two countries;
EMPHASIZING that the Joint Crediting Mechanism will promote economic cooperation between the two countries;
RECOGNIZING that the Joint Crediting Mechanism will be implemented more effectively when there is good cooperation, coordination and collaboration between both governments;
HAVE REACHED the following recognition:
I. ESTABLISHMENT OF THE JOINT CREDITING MECHANISM
1. Both governments in pursuit of the objectives of the Paris Agreement including holding the increase in the global average temperature to well below 2 °C above pre-industrial levels and pursuing efforts to limit the temperature increase to 1.5 °C above pre-industrial levels as stipulated in its Article 2, paragraph 1, sub-paragraph (a), and in order to enhance bilateral cooperation in addressing climate change, establish a Joint Crediting Mechanism (hereinafter referred to as "the JCM").
II. OBJECTIVE
2. The objective of this Memorandum of Corporation (hereinafter referred to as "this MoC") is to facilitate the cooperation between both governments in the diffusion of, among others, leading decarbonizing technologies, products, systems, services and infrastructure as well as implementation of mitigation actions, thereby contributing to greenhouse gas emissions reductions or removals and sustainable development in the United Republic of Tanzania, and the achievement of nationally determined contributions of Japan and the United Republic of Tanzania.
III. JOINT COMMITTEE
3. Both governments establish the Joint Committee consisting of representatives from each government to implement the JCM.
4. The Joint Committee established under paragraph 3 above develops rules and guidelines necessary for the implementation of the JCM, relating to project cycle procedures, methodologies, project design documents, monitoring, designation of third-party entities, validation and verification and other related matters of the JCM.
IV. AUTHORIZATION AND USE OF JCM CREDITS
5. Both governments mutually recognize that part of JCM credits issued from emission reductions and removals may be used towards the achievement of Japan's nationally determined contribution and the rest of the said JCM credits may contribute to the achievement of the United Republic of Tanzania's nationally determined contribution, while ensuring that double counting is avoided on the basis of corresponding adjustments, consistent with the guidance on cooperative approaches, referred to in Article 6, paragraph 2 of the Paris Agreement (hereinafter referred to as "the guidance").
6. Each government authorizes the JCM credits issued in the JCM registry of Japan for use towards the achievement of Japan's nationally determined contribution as internationally transferred mitigation outcomes, consistent with the guidance.
7. Each government may authorize part of JCM credits for use for other international mitigation purposes, as appropriate, consistent with the guidance.
V . TRANSPARENCY
8. Both governments ensure the transparency and environmental integrity of the JCM and maintain it simple and practical, to promote concrete actions for global greenhouse gas emission reductions and removals.
VI. CAPACITY BUILDING
9. In the implementation of JCM, the Government of Japan will facilitate technological and capacity building support necessary for the administration of the JCM by the Government of the United Republic of Tanzania.
10. Both governments aim for contributions to assist adaptation efforts of developing countries.
VII. CONFIDENTIALITY
11. All information obtained by either government through the implementation of the JCM is held in confidence and is used exclusively for the purpose of the implementation of the JCM unless obtaining prior written consent of a concerned party.
12. In the event of the discontinuation of this MoC, both governments continue to observe confidentiality with respect to existing projects or activities under this MoC.
VIII. DURATION
13. This MoC will commence on the date of its signature and will remain in operation until discontinued by either government in line with paragraph 14.
IX. DISCONTINUATION
14. Either government may discontinue this MoC by giving at least six (6) months' prior notice to the other government through diplomatic channels. Such discontinuation will not affect existing projects or activities under this MoC.
X. MODIFICATION
15. Any content of this MoC may be modified and supplemented by mutual written consent between both governments.
XI. RESOLUTION OF DIFFERENCES
16. Any differences in the interpretation, application and implementation of this MoC will be resolved amicably through consultations between both governments.
XII. OTHER MATTERS
17. Both governments implement the JCM in line with the relevant domestic laws and regulations in force in their respective countries.
18. This MoC is not legally binding and does not create any legal rights or obligations. Contents of this MoC will not affect any of rights and obligations of both governments, arising from the applicable international agreements.
