MEMORANDUM OF UNDERSTANIDING BETWEEN THE DEPARTMENT OF SOCIAL AFFAIRS OF THE REPUBLIC OF INDONESIA AND THE ASIAN WOMEN' S FUND CONCERNING PROMOTION OF SOCIAL WELFARE SERVICES FOR ELDERLY PEOPLE IN INDONESIA

The Department of Social Affairs of Indonesia (DSA) and the Asian Women's Fund (AWF), hereinafter referred to as the Parties;

RECOGNIZING that victim who underwent immeasurable and painful experiences and suffered incurable physical and psychological wounds as "wartime comfort women" exist in Indonesia;

DESIRING to improve social welfare services for elderly people in Indonesia; HAVE AGREED AS FOLLOWS:

Article 1

GOALS

The promotion of social welfare services for elderly people in Indonesia.

Article 2

IMPLEMENTATION

1. The implementation of the promotion of social welfare services for elderly people in Indonesia shall be, hereinafter, referred as the Project.

2. The DSA shall implement the Project, the total cost of which amounts 380,000;000 (three hundred and eighty million) yen. The DSA shall develop an annual plan for implementation of the Project in consultation with the AWF. The AWF shall provide the financial resources to the DSA, which are necessary for implementing the Project.

3. The DSA shall assure that the Project be implemented in the regions where former "wartime comfort woman" seem to exist, The Project shall be implemented in such a manner that priority be given to women.

4. The DSA shall guarantee for appropriate management and use of funds it receives from the AWF.

Article 3

REPORT AND CONSULTATION

1. The,DSA shall evaluate implementation of the Project and provide annual report to the AWF. The DSA shall accept observers from the AWF to the citas of the Project when the AWF so requests.

2. The Parties shall consult each other regarding the implementation of the Project.

Article 4

FINAL PROVISION

1. This Memorandum of Understanding shall take effect on the date of its signing.

2. This Memorandum of Understanding shall remain in force for the period of 10 (ten) years. Either Party may .terminate this Memorandum of Understanding by giving notice in writing to that effect to the other Party 6 (six) months prior to the date fixed for such termination.

3, Any dispute arising out of the interpretation and implementation of this Memorandum of Understanding shall be settled amicably through consultation or negotiation between the Parties.

4. This Memorandum of Understanding may be amended, if it is deemed necessary, by mutual consent in writing between the Parties.
