[Title] Additional Article of Treaty of Amity and Commerce and Navigation between the Republic of Chile and the Empire of Japan
THE REPUBLIC OF CHILE.
TREATY OF AMITY, COMMERCE AND NAVIGATION.
ADDITIONAL ARTICLE.
Signed at Tokio, in English, Japanese and Spanish, October 16, 1899 (32nd year of Meiji).
Ratified June 28, 1903 (39th year of Meiji).
Ratifications exchanged at Tokio, September 24, 1906.
Promulgated November 6, 1906.
His Majesty the Emperor of Japana and His Excellency the President of the Republic of Chile, desireing to clearly explain the scope of the stipulations relating to most favored nation treatment contained in the Treaty of Amity, Commerce and Navigation, signed at Washington on the 25th day of the 9th month of the 30th year of Meiji, corresponding to the 25th day of September, 1897, have, with that object, appointed and authorized, that is to say: His Majesty the Emperor of Japan, Viscount Siuzo Aoki, His Imperial Majesty's Minister of State for Foreign Affairs, and His Excellency the President of the Republic of Chile, Don Carlos Morla Vicuña, Envoy Extraordinary and Minister Plenipotentiary of Chile at the Court of His Majesty the Emperor of Japan, to agree to the following additional article:
The High Contracting Parties agree that, subject to the reservation hereinafter stated, all special favours, privileges or immunities in matters of commerce or navigation which have been granted or may hereafter be granted by one them to the subjects or citizens, or to the vessels or products of any other Nation, shall be granted on the like terms and conditions, to the subjects or the citizens, or to the vessels or the products of the other Contracting Party. Consequently, subject to the said reservation, the subjects, vessels and products of Japan in Chile and the citizens, vessels and products of Chile in Japan shall enjoy respectively all favours, privileges or immunities granted to the subjects or citizens or to the vessels or products of any other Nation.
There are, however, excepted from the foregoing stipulation all special favours, privileges or immunities relating to commerce or navigation which Japan has already granted or may hereafter grant to any independent Asiatic Nation, as well as the like special favours, privileges or immunities which Chile has already granted or may hereafter grant to the Latin American Republics.
The present Article shall be regarded as forming an integral part of the Treaty of Amity, Commerce and Navigation, signed at Washington on the 25th day of the 9th month of the 30th year of Meiji, corresponding to the 25th day of September, 1897, in the same manner as if it had been incorporated word by word in the Treaty itself. It shall be submitted to the ratification of the High Contracting Prties, in conformity with their respective constitutional provision, and the ratifications shall be exchanged together with those of the Treaty of which it is a part.
In witness whereof, the respective Plenipotentiaries have signed this Additional Article and hereunto affixed their respective seals.
Done in sextuplicate at Tokyo this 16th day of the 10th month of the 32nd year of Meiji, corresponding to the 16th day of October, 1899.
