[Title] AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL ON CO-OPERATION IN THE FIELD OF SCIENCE AND TECHNOLOGY
AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL ON CO-OPERATION IN THE FIELD OF SCIENCE AND TECHNOLOGY
The Government of Japan and the Government of the Federative Republic of Brazil,
Recognizing the increasing importance in recent years of co-operation in the field of science and technology between the two countries,
Believing that such co-operation will con tribute to the economic and social progress of their respective countries,
Aiming at further promoting such co-operation,
Have agreed as follows:
Article I
The two Governments shall, on the principle of equality and mutual benefit, promote co-operation in the field of science and technology between them. Such co-operation will, be undertaken between the two Governments in such areas of science and technology as may be mutually agreed.
Article II
Forms of the co-operative activities under this Agreement may include:
(a) Meetings of various forms to discuss and exchange information on science and technology;
(b) Dispatch and reception of scientists and technical personnel;
(c) Exchange of information on science and technology;
(d) Implementation of joint or co-ordinated projects and programmes for scientific research and technological development; and
(e) Other forms of co-operation as maybe mutually agreed.
Article III
The two Governments shall establish a Joint Committee on Japanese-Brazilian Co-operation in Science and Technology (herein after referred to as "the Committee") for
the achievement of the aim of this Agreement. The Committee shall meet alternately in Japan and in Brazil on dates to be determined through diplomatic channels.
Article IV
1. The Committee shall have the following functions:
(a) To discuss major policy issues relating to the implementation of this Agreement;
(b) To review the progress of the implementation of this Agreement; and
(c) To propose to the two Governments as regards specific measures to ensure the enhancement of co-operation under this Agreement.
2. Contacts concerning the functions of the Committee when it is not in session shall be conducted through diplomatic channels.
Article V
Implementing arrangements setting forth the details and procedures of the specific co-operative activities under this Agreement may be made between the two Governments or their agencies, whichever is appropriate.
These implementing arrangements shall be made in accordance with the administrative practices of each Government.
Article VI
The respective Governments shall accord to the nationals of the other country facilities necessary for the carrying out of the activities under this Agreement.
Article VII
The provisions of this Agreement shall be implemented in accordance with the laws and regulations in force in each country.
Article VIII
Nothing in this Agreement shall be construed to prejudice other arrangements for co-operation between the two Governments, existing at the date of signature of this Agreement or concluded thereafter.
Article IX
1. This Agreement shall enter into force on the date of receipt by the Government of Japan of a note from the Government of the Federative Republic of Brazil stating that necessary formalities for the entry into force of the Agreement have been completed. This Agreement shall remain in force for two years, and shall continue in force thereafter
until terminated in accordance with the provisions of paragraph 2 below.
2. Either Government may, by giving a written notice of six months to the other Government, terminate this Agreement at the end of the initial period of two years or at any time thereafter.
3. The termination of this Agreement shall not affect the carrying out of any project or programme undertaken under this Agreement and not fully implemented at the time of the termination of this Agreement.
IN WITNESS WHEREOF, the undersigned, duly authorized thereto by their respective Governments, have signed this Agreement.
DONE in duplicate at Tokyo on May 25, 1984, in the Japanese, Portuguese and English Ian guages, each text being equally authentic.
In case of any divergence of interpretation, the English text shall prevail.
