[Title] Exchange of Notes Constituting an Agreement Amending the Agreement between the Government of Japan and the Government of the Republic of Korea for Air Services

Excellency,
I have the honour to refer to the consultations which took place in Tokyo from June 5 to 7, 1991, in accordance with Articles 12 and 14 of the Agreement between the Government of the Republic of Korea and the Government of Japan for Air Services, signed on May 16, 1967.
Pursuant to an agreement reached at the said consultations, I have the honour to propose, on behalf of the Government of the Repu{sic}lic of Korea, that the Schedule of the said Agreement be replaced by the revised Schedule set out in the enclosure to this Note, and that paragraph 1 of the Letters of May 16, 1967 relative to the said Agreement, which were exchanged between the two Governments, be revised as follows:
"1. The designated airlines of the Republic of Korea and the designated airlines of Japan may operate air services through any point or points in their respective countries by the same flight. However, for the designated airlines of the Republic of Korea, the total number of gateway points in the Republic of Korea shall not exceed four (4) including Seoul and Pusan, and for the designated airlines of Japan, the total number of gateway points in Japan shall not exceed fifteen (15) including Tokyo, Osaka and Fukuoka."
If the above proposal is acceptable to the Government of Japan, I have further the honour to propose that this Note and Your Excellency's reply in that sense shall be regarded as constituting an agreement between the two Governments on this matter, which will enter into force on the date of Your Excellency's reply.

SCHEDULE
1. Routes to be operated in both directions by the designated airline or airlines of Japan:
(a) Points in Japan - Pusan - Seoul and points beyond
(b) Points in Japan - Pusan - Cheju
(c) Points in Japan - a point in the Republic of Korea other than Seoul, Pusan and Cheju
Notes: (1) The designated airline or airlines of Japan may not operate to more than six (6) different points beyond on Route (a).
(2) The designated airline or airlines of Japan may operate to either both Pusan and Seoul or both Pusan and Cheju.
2. Routes to be operated in both directions by the designated airline or airlines of the Republic of Korea:
(a) Points in the Republic of Korea - Tokyo - Honolulu - Los Angeles
(b) Points in the Republic of Korea - Osaka - Taibei - Hong Kong - Ho Chi Minh City - Bangkok
(c) Points in the Republic of Korea - Fukuoka
(d) Points in the Republic of Korea - Nagoya
(e) Points in the Republic of Korea - Kumamoto and/or Kagoshima
(f) Points in the Republic of Korea - one point either Niigata or Komatsu
(g) Points in the Republic of Korea - Sapporo
(h) Points in the Republic of Korea - Nagasaki
(i) Points in the Republic of Korea - Sendai
(j) Points in the Republic of Korea - Hiroshima
(k) Points in the Republic of Korea - Okayama
(l) Points in the Republic of Korea - Naha
(m) Points in the Republic of Korea - Oita
(n) Points in the Republic of Korea - Takamatsu
Note: The designated airline or airlines of the Republic of Korea may not operate to Bangkok until the designated airline or airlines of Japan operate to a point beyond the Republic of Korea.
3. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on any of the routes may at the option of the designated airline be omitted on any or all flights.

I have further the honour to inform Your Excellency, on behalf of the Government of Japan, that the Government of Japan accepts the above proposal of the Government of the Republic of Korea and to confirm that Your Excellency's Note and this reply are regarded as constituting an agreement between the two Governments on this matter, which enters into force on this date.
I avail myself of this opportunity to renew to Your Excellency the assurances of my highest consideration.
