[Title] Exchange of Notes between the Government of Japan and the Government of Australia concerning cooperation for the Geostationary Meteorological Satellite-3 System Project

Sir,

I have the honour to refer to the recent negotiations held between the representatives of the Government of Japan and of the Government of Australia concerning co-operation on the project for the Geostationary Meteorological Satellite-3 System (hereinafter referred to as "the System") which the Government of Japan will bring into operation, through the Geostationary Meteorological Satellite-3 which was launched in August, 1984 and which will be eventually placed in the geostationary orbit at 140 degrees E, with a view to contributing to the development of meteorological satellite technology and the improvement of meteorological services of Japan as well as with a view to continuing its participation in the ongoing world weather watch program of the World Meteorological Organization. I there-fore propose the following arrangements for this co-operation:

1. At the request of the Government of Australia, the Government of Japan shall make, within the scope of the laws and regulations of Japan, special meteorological observations through the System and provide the Government of Australia with the information and data derived from such observations, as far as the technical capacity of the System and service capacity of the Japan Meteorological Agency allow, and as long as the System continues to operate in a normal condition.

2. When the Government of Australia makes a request for the information and data derived from meteorological observations through the System for its research purposes, the Government of Japan shall give due consideration to such a request.

3. The Government of Australia shall, at its own expense, operate and maintain the Turnaround Ranging Station required for the trilateration of the Geostationary Meteorological Satellite-3 and installed pursuant to the Exchange of Notes of July 7, 1977 and augmented pursuant to the Exchange of Notes of September 22, 1981 as long as the System continues to operate in a normal condition.

4. The details and procedures for co-operation in the present project shall be provided for in the implementing arrangement to be entered into between the Japan Meteorological Agency, Ministry of Transport and the Australian Bureau of Meteorology, Department of Science.

5. Nothing in the present arrangements shall be construed to prejudice the arrangements contained in the Exchanges of Notes mentioned in Paragraph 3.

6. The two Governments shall consult with each other on any problem that may arise from or in connection with co-operation in the present project.

I have further the honour to propose that the present Note and your Note in reply confirming the foregoing arrangements on behalf of the Government of Australia shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the date of your reply.
