[Title] PROTOCOL SUSPENDING THE APPLICATION OF SAFEGUARDS UNDER THE AGREEMENT BETWEEN THE INTERNATIONAL ATOMIC ENERGY AGENCY,THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF JAPAN FOR THE APPLICATION OF AGENCY SAFEGUARDS IN RESPECT OF THE BILATERAL AGREEMENT BETWEEN THOSE GOVERN-MENTS FOR CO-OPERATION IN THE PEACEFUL USES OF ATOMIC ENERGY
PROTOCOL SUSPENDING THE APPLICATION OF SAFEGUARDS UNDER THE AGREEMENT BETWEEN THE INTERNATIONAL ATOMIC ENERGY AGENCY,THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF JAPAN FOR THE APPLICATION OF AGENCY SAFEGUARDS IN RESPECT OF THE BILATERAL AGREEMENT BETWEEN THOSE GOVERN-MENTS FOR CO-OPERATION IN THE PEACEFUL USES OF ATOMIC ENERGY
The International Atomic Energy Agency, the Government of Canada and the Government of Japan;
RECALLING the Agreement between the Government of Canada and the Government of Japan for co-operation in the Peaceful Uses of Atomic Energy signed at Ottawa on 2 July 1959 (hereinafter referred to as to the Co-operation Agreement" ) as well as the Agreement between the International Atomic Energy Agency, the Government of Canada and the Government of Japan for the Application of Agency Safeguards in respect of the Co-operation Agreement signed at Vienna on 2O June 1966 (hereinafter referred to as "the Trilateral Agreement" );
NOTING the adherence of Canada and Japan to the Treaty on the Non-Proliferation of Nuclear Weapons;
HAVE agreed as follows:
ARTICLE I
For such time as the Agreement concluded between either Party to the Co-operation Agreement and the International Atomic Energy Agency in implementation of Article III, l and 4 of the Treaty on the Non-Proliferation of Nuclear Weapons (hereinafter referred to as "the Safeguards Agreement") is in force, the application of the safeguards of the Trilateral Agreement shall be suspended, insofar as that Party to the Co-operation Agreement is concerned.
ARTICLE II
This Protocol shall enter into force on the date of signature and shall remain in force for as long as either of the Safeguards Agreement s remains in force.
DONE in Vienna this 2nd day of December 1977 in triplicate in the English and French languages, the texts in both languages being equally authentic.
